About This Session

As AI tools become embedded in hiring, promotion, and workforce analytics, and pay equity laws expand across states, employers face a complex and evolving compliance landscape. This session will explore California’s AI regulations under the Fair Employment and Housing Act (FEHA) and the Transparency in Frontier Artificial Intelligence Act (TFAIA), effective January 1, 2026. We’ll also review recent case law, including the Workday AI bias lawsuit, and provide a 2026 tracking guide for legislation, litigation, and compliance priorities.

Key Learning Points

  • Review key pay equity and wage transparency mandates and how they affect job postings, internal mobility, and candidate communications.
  • Explore disclosure frameworks including ISO 30414, GRI 405, and SEC human capital reporting.
  • Analyze recent case law, including the Workday collective action lawsuit under ADEA for AI-driven hiring bias.
